California ADU Laws: 2025 Update

California continues to lead the nation in ADU-friendly legislation. Here's everything you need to know about the current laws and how they affect your ADU project.

Key Laws Currently in Effect

AB 976 — No Owner-Occupancy Requirement (Permanent) Previously, some cities required property owners to live on-site if they had an ADU. AB 976 permanently eliminates this requirement for standard ADUs, meaning you can rent out both your main home and your ADU.

Exception: JADUs still require owner-occupancy of either the main home or the JADU.

AB 1033 — ADU Separate Sale This groundbreaking law allows ADUs to be sold separately from the main home as condominiums. This means:

  • Your ADU can be its own sellable property
  • Buyers can purchase just the ADU (potentially at a lower price point)
  • This creates new affordable homeownership opportunities

Note: Cities must opt in to AB 1033, so check your local jurisdiction.

AB 434 — Pre-Approved ADU Plans Requires all California cities to develop pre-approved ADU plans by January 1, 2025. Benefits:

  • Faster permitting (often 2-3 weeks instead of 6-8)
  • Lower design costs
  • Reduced plan check fees in some cities
  • Certainty of approval

SB 13 / AB 68 / AB 881 — Core ADU Framework These foundational laws established:

  • 60-day permit review timeline
  • Ministerial (non-discretionary) approval
  • Reduced setbacks (4 feet rear and side)
  • Elimination of parking requirements for conversions
  • Fee waivers for units under 750 sq ft
  • Allowance for both an ADU and JADU on single-family lots

AB 670 — HOA Restrictions Homeowners associations cannot prohibit ADUs on single-family lots. While HOAs can impose reasonable design standards, they cannot effectively prevent ADU construction.

Size & Setback Rules

ADU Type Maximum Size Setback Requirements
Detached 1,200 sq ft 4 ft rear and sides
Attached 50% of existing home 4 ft rear and sides
Garage Conversion Existing structure None (existing location)
JADU 500 sq ft None (within existing home)

What's Coming Next

The California legislature continues to consider new ADU-related bills. Trends to watch:

  • Further streamlining of permitting processes
  • Additional incentives for affordable ADU rentals
  • Expansion of ADU separate sale provisions
  • Potential state-level ADU financing programs
