What Changed in California ADU Law for 2025

California continues to lead the nation in ADU-friendly legislation. Here's a comprehensive breakdown of the current rules every homeowner should know.

AB 1033: Sell Your ADU Separately

The biggest game-changer: homeowners can now potentially sell their ADU as a separate condominium. This means:

  • Your ADU could be sold independently from your primary home
  • ADU values as standalone units: $300,000-$500,000+ in desirable markets
  • Creates a new class of affordable homeownership
  • Local jurisdictions must opt in (check with your city)

Key State ADU Rules

Size Limits:

  • Detached ADU: Up to 1,200 sq ft
  • Attached ADU: Up to 1,200 sq ft (or 50% of primary home, whichever is less)
  • Junior ADU (JADU): Up to 500 sq ft
  • You CAN build both an ADU + JADU on a single-family lot

Setback Requirements:

  • Rear and side setbacks: 4 feet minimum
  • No setback required for garage conversions in existing footprint
  • Front setback follows existing zoning

Parking:

  • No parking required for ADUs if within 1/2 mile of public transit
  • No parking required for garage conversions
  • No parking required if within one block of a car-share vehicle
  • At most, one space can be required

Fees:

  • No impact fees for ADUs under 750 sq ft
  • Proportional fees for ADUs 750+ sq ft
  • No school fees for ADUs
  • Utility connection fees capped and reduced

Permit Timeline Protections

Cities must act on ADU applications within 60 days for ministerial review. If your city fails to act within 60 days, your ADU is considered automatically approved by law.

Owner-Occupancy Rules

  • No owner-occupancy requirement for ADUs permitted before January 1, 2025
  • ADUs permitted after January 1, 2025: some cities may reinstate owner-occupancy requirements — check local rules
  • JADUs always require owner-occupancy of either the JADU or the primary home

HOA Restrictions

State law prohibits HOAs from:

  • Banning ADUs outright
  • Imposing unreasonable restrictions that effectively prevent ADU construction
  • Requiring approval processes that exceed what the city requires

However, HOAs may still impose reasonable architectural and design standards.

What This Means for Your Investment

The combination of AB 1033 (separate ADU sales), eliminated fees for small ADUs, and streamlined permitting makes 2025 the best year ever to build an ADU in California. The regulatory environment has never been more favorable.
