The state minimum

California state law (Gov. Code §65852.2) caps ADU setbacks at 4 feet from side and rear lot lines for new construction. Cities cannot require more for new ADUs in most cases.

Front setbacks

Front setbacks are governed by the city's underlying zone — typically 15–25 feet. ADUs generally must respect this.

Garage and structure conversions

Converted structures (existing garages or other accessory buildings) can have zero setback as long as the original structure was legal. The 4-foot rule does not apply to conversions.

Special situations

  • Detached ADUs on corner lots: Street-side setbacks follow zone rules
  • Two-story ADUs: Some cities require additional setback for the second story (state law allows up to 5 ft additional)
  • Hillside lots: Slope and erosion review can affect setback flexibility
  • Fire-rated walls: ADUs within 5 feet of a property line may need 1-hour fire-rated exterior walls

Common setback mistakes

  • Measuring from the wrong baseline (always measure to the property line, not the fence)
  • Forgetting eaves count toward setback in many cities
  • Building over existing easements (utility, drainage)

Frequently Asked Questions

What is the minimum ADU setback in California in 2026?

4 feet from side and rear lot lines for new construction; 0 feet for legal existing structure conversions.

Can my city require larger setbacks than 4 feet?

Generally no — state law caps them. Limited exceptions exist for second-story ADUs.

Do eaves count toward setback?

In most California cities, roof eaves can extend 2 feet into a required setback without violating it.

What about ADUs built right up to the property line?

Only allowed for converted existing structures that already encroached when built.

What if my fence is on my neighbor's side of the property line?

Always measure to the actual surveyed line, not to the fence. Mistakes here cause permit denials.
