Owner Occupancy and ADUs: The Complete 2026 Guide
One of the most common questions we get is: "Do I have to live on my property to build or rent out an ADU?" The answer has changed significantly thanks to recent California legislation.
The Current Rule: No Owner Occupancy Required for ADUs
As of January 1, 2025, California law (AB 976) permanently eliminated owner-occupancy requirements for standard ADUs. This means:
- You do not need to live on the property to build an ADU
- You can rent out both your main home and your ADU simultaneously
- There is no owner-occupancy requirement at any point -- not when you build, not when you rent
- Cities cannot impose local owner-occupancy requirements for ADUs
This is a major win for homeowners and investors. Previously, many cities required the homeowner to live in either the main home or the ADU. That restriction is now permanently gone.
The Exception: JADUs Still Require Owner Occupancy
There is one important exception: Junior ADUs (JADUs) still require owner-occupancy. If you build a Junior ADU, the property owner must live in either the main home or the JADU.
Why the difference? JADUs are created within the existing home's footprint and share some facilities with the main home (like utilities and possibly a shared entrance). The legislature treated them differently from standard ADUs.
What This Means in Practice
If you have a standard ADU (attached or detached):
- Build it, rent it, and live wherever you want
- Rent out both the main home and the ADU
- Use it as an investment property
- Move away and keep collecting rent
If you have a JADU:
- You or the property owner must reside on the property
- You can rent the JADU to a tenant while living in the main home
- Or live in the JADU and rent the main home
- But someone with an ownership interest must occupy one of the units
Can I Build Both a JADU and an ADU?
Yes! California law allows you to build both a JADU and a standard detached ADU on the same single-family lot. This means you could have three living units on one property:
- Main home (rent it out)
- JADU within the main home (requires your occupancy)
- Detached ADU in the backyard (rent it out)
This triple-income strategy is increasingly popular in Los Angeles, Pasadena, and throughout Orange County.
What About HOAs?
Homeowners associations cannot prohibit ADUs under California law. However:
- HOAs can impose reasonable design standards (consistent with the neighborhood aesthetic)
- HOAs cannot add owner-occupancy requirements beyond what state law requires
- HOAs cannot charge unreasonable fees for ADU construction
Impact on Your Rental Strategy
The elimination of owner-occupancy requirements opens up powerful investment strategies:
Strategy 1: Live and Rent
Live in your main home, rent the ADU for $2,000-$3,500/month. Most popular strategy.
Strategy 2: House Hack
Live in the ADU, rent the main home for maximum rental income. The main home commands higher rent than the ADU.
Strategy 3: Full Investment
Rent both the main home and the ADU. Live elsewhere. Maximum rental income with no occupancy requirement.
Strategy 4: Family Housing
House aging parents in the ADU (or main home) while renting the other unit. No owner-occupancy concern since the family member lives on-site.

Cities That Previously Had Owner-Occupancy Requirements
Before AB 976, many cities imposed owner-occupancy rules. These are all now preempted by state law:
- Los Angeles: Previously required for ADUs built after 2020
- Pasadena: Had owner-occupancy deed restrictions
- Santa Monica: Required owner occupancy
- Glendale: Had local owner-occupancy ordinance
All of these requirements are now void. State law supersedes any local ordinance. For the full picture, read our complete guide to California's ADU laws.
